TERMS OF SERVICE

1. Purpose

These Terms of Service ("ToS") govern access to and use of the TradeTrackr web application, published by Simon Rohart, individual entrepreneur, registered under SIRET 905 083 440 00016.

By accessing or using the application, the user acknowledges having read, understood, and accepted these Terms of Service without reservation.

2. Service Description

TradeTrackr is a digital trading journal and performance analysis platform designed for individual and professional traders. The application allows users to:

• Maintain a personal trading journal
• Access trading performance statistics and metrics
• Manage a watchlist of financial assets
• View market data and aggregated financial news
• Perform chart analysis using artificial intelligence tools (subject to subscription plan)

TradeTrackr does not provide investment advice, trading signals, or recommendations to buy or sell financial instruments.

3. Access to the Service

Access to the application requires the creation of a user account, either via a registration form or through a third-party authentication provider (such as Google or Apple).

The user agrees to provide accurate, complete, and up-to-date information and to keep such information current.

Minimum Age

The application is reserved for users aged 16 years or older. By creating an account, the user confirms that they meet this requirement.

TradeTrackr reserves the right to suspend or delete any account that does not comply with these conditions.

4. Subscriptions and Features

TradeTrackr offers the following subscription plans:

Payments are processed securely by Stripe. Users may manage, modify, or cancel their subscription at any time through the Stripe customer portal available within the application.

Subscriptions are automatically renewed unless cancelled before the renewal date.

5. AI Credits Usage

AI analysis credits are consumed each time an AI chart analysis is performed. Credits are allocated monthly and reset automatically on the subscription renewal date.

Unused credits do not roll over to the next billing cycle. Once all credits are consumed, access to AI analysis features is suspended until the next renewal period.

6. Termination and Account Deletion

Users may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.

TradeTrackr reserves the right to suspend or terminate a user account, without notice, in cases of:

• Violation of these Terms of Service
• Fraudulent or abusive behavior
• Security or technical risks to the platform

In the event of account deletion, user data will be permanently deleted within 30 days, unless legal or regulatory obligations require longer retention.

7. Responsibilities and Disclaimer

The application is provided "as is" and "as available", without any guarantee of uninterrupted service, accuracy, or performance.

TradeTrackr shall not be held liable for:

• User misuse of the application
• Temporary service interruptions or technical issues
• Data loss not attributable to gross negligence
• Financial losses, missed opportunities, or investment decisions made by the user

All analyses, statistics, and AI-generated outputs are provided for informational and educational purposes only and do not constitute financial advice.

The user remains solely responsible for all trading decisions and financial outcomes.

8. Limitation of Liability

To the maximum extent permitted by law, TradeTrackr's total liability shall not exceed the total amount paid by the user for the service during the twelve (12) months preceding the event giving rise to the claim.

9. Intellectual Property

All content, software, trademarks, logos, designs, and functionalities of TradeTrackr are the exclusive property of the publisher.

Any reproduction, distribution, modification, or exploitation without prior written authorization is strictly prohibited.

10. Data Protection

Personal data is processed in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

Details regarding data collection, processing, and user rights are described in the Privacy Policy available within the application.

TradeTrackr does not sell or rent user data to third parties.

11. Third-Party Services

The application may rely on third-party services (such as payment processors or authentication providers). TradeTrackr shall not be held responsible for the availability, functionality, or security of such external services.

12. Modifications to the Terms

TradeTrackr reserves the right to modify these Terms of Service at any time. Users will be informed of material changes through the application.

Continued use of the service after modifications constitutes acceptance of the updated Terms.

13. Force Majeure

TradeTrackr shall not be held liable for failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, network failures, or governmental actions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service constitute the entire agreement between the user and TradeTrackr regarding use of the application.

16. Applicable Law and Jurisdiction

These Terms of Service are governed by French law.

Any dispute shall be subject to the exclusive jurisdiction of the courts located within the jurisdiction of the publisher's registered office.
